Additionally, the demolition order must clearly state the reasons for the action. Mandatory Notice and Waiting Period As per the Uttar Pradesh Urban Development Department s directives, no demolition can proceed without first serving a show cause notice to the property owner or occupant. Authorities must wait at least 15 days after issuing the notice, allowing the concerned party time to either remove the unauthorized structure or apply for regularization. Strict Compliance with Supreme Court Guidelines To ensure adherence to legal protocols, the state government has instructed all local bodies to follow these regulations. On January 15, 2025, the Chief Secretary reinforced the importance of compliance with Supreme Court guidelines, particularly regarding the issuance and acknowledgment of notices. To prevent backdated notices, agencies are required to send a digital notification of every demolition notice to the District Magistrate s (DM) office via email. The DM s office, in turn, must acknowledge receipt through an automated response, ensuring transparency in the process. Implementation of a Digital Records Portal Within the next three months, municipal and local authorities must establish a dedicated digital portal to store and manage all demolition-related documentation. This portal will archive: Issued notices Property owner responses Show cause notices Final demolition orders This system will ensure that records remain accessible, reducing the risk of procedural lapses or disputes. Fair Hearings & Legal Compliance Before issuing a final demolition order, authorities must conduct a formal hearing for the affected parties and maintain proper documentation of the proceedings. The order should explicitly state whether the unauthorized construction can be regularized upon payment of penalties or if demolition is unavoidable. Strict legal action will be taken against officials who fail to comply with these guidelines, reinforcing accountability within municipal and development agencies. Temporary vs. Permanent Constructions The new guidelines apply specifically to permanent structures, while temporary encroachments will continue to be addressed under the UP Municipal Corporation Act.
