NCLT Declares Ansal API Bankrupt, Leaving Thousands of Investors in Uncertainty

The National Company Law Tribunal (NCLT) has officially declared real estate developer Ansal API bankrupt, leading to widespread concern among homebuyers and investors. This decision has triggered protests from those who have invested in Ansal API s projects in Lucknow, Noida, and other cities, fearing significant financial losses. The fate of their investments remains uncertain, leaving thousands of people in distress. Over 3,000 Investors Affected by Ansal API s Bankruptcy Ansal API's bankruptcy has left over 3,000 homebuyers and investors in turmoil, particularly those who had invested in: Plots, flats, and villas in Sushant Golf City, Lucknow Commercial spaces across Noida, Lucknow, and other cities Many investors who purchased properties as early as 2009 are yet to receive possession, raising concerns about financial security and project completion. Allegations of Fund Misuse and Loan Default Protesters have alleged that despite collecting over Rs 650 crore from investors in the past six months, the developer failed to clear its outstanding debts. The company's default on loan repayments led to its bankruptcy proceedings, freezing all legal claims and investor grievances. Legal Implications: Investors Unable to Seek Refunds Following the NCLT s insolvency declaration, investors are now barred from taking legal action against Ansal API. This means: No legal proceedings can be initiated against the developer. Investors cannot seek refunds through RERA or the High Court. All financial claims against the company remain on hold until further notice. Appointment of Interim Resolution Professional (IRP) The NCLT has appointed an Interim Resolution Professional (IRP) to: Investigate Ansal API s projects and financial records. Conduct an evaluation of assets in Noida, Lucknow, and other cities. Formulate a resolution plan for pending claims. However, this process may take years, further delaying any potential relief for affected investors. Investors Appeal for Government Intervention Frustrated homebuyers and investors are now urging the Uttar Pradesh government to intervene. Many are seeking the support of: Chief Minister Yogi Adityanath to push for regulatory action. Sarojini Nagar MLA Rajeshwar Singh to represent their case. Defence Minister Rajnath Singh to escalate their concerns at a national level.
