House Rent Allowance (HRA) is a component of an employee's salary intended to cover housing expenses. Under Section 10(13A) of the Income Tax Act, salaried individuals can claim tax exemptions on HRA, provided specific conditions are met. Notably, the Act does not mandate that the rented accommodation be in the same city as the workplace. Therefore, employees residing in a different city from their place of employment can still claim HRA for the rent paid, as long as the residence is occupied by the employee and other stipulated conditions are satisfied. Key Conditions for Claiming HRA: Actual Rent Payment: The employee must be paying rent for the residential accommodation they occupy. Rent Agreement: A valid rental agreement between the employee and the landlord should be in place. Rent Receipts: Maintain rent receipts as proof of payment. Employer Declaration: Provide necessary declarations and documentation to the employer to avail of HRA benefits. HRA Calculation Factors: The HRA exemption amount is determined by the least of the following: Actual HRA Received: The HRA component specified in the salary. Rent Paid Minus 10% of Salary: The excess of rent paid over 10% of the basic salary. 50% or 40% of Basic Salary: For metro cities (Delhi, Mumbai, Kolkata, Chennai), it's 50% of the basic salary; for non-metro cities, it's 40%. Documentation Required: Rent Agreement: A formal agreement detailing the rental terms. Rent Receipts: Monthly receipts acknowledging rent payment. Landlord's PAN: If annual rent exceeds ₹1 lakh, the landlord's PAN is mandatory. Special Considerations: Rent Paid to Family Members: It's permissible to pay rent to parents and claim HRA, provided a legitimate rental agreement exists, and the transaction is transparent. The rented premises should not be owned by the employee. Simultaneous Home Loan and HRA Claims: An individual can claim both HRA for rented accommodation and tax benefits on home loan interest, especially if the owned property is in a different city from the workplace. In summary, employees paying rent for accommodation in a city different from their workplace are eligible to claim HRA, subject to compliance with the specified conditions and proper documentation.
